What Lowe Estates Homeowners Association's governing documents say
Lowe Estates is a single-family home HOA in Gilbert, AZ, recorded in 1984. The community is split into two areas: Lexington Area (Lots 171–289) for detached homes, and Concord Area (Lots 1–170) for homes that may share common walls. Rules apply to all lots and are enforced by the homeowners association and a Deed Restriction Review Committee.
- Residential use & building requirements: Each lot is limited to one single-family residence. Lexington homes must be at least 1,400 sq. ft. of ground-floor livable area (excluding garage, porches, etc.), have a two-car garage with auto opener, and be brick construction. Concord homes must be at least 1,000 sq. ft., have a two-car garage, and at least one bathroom. No plastic or aluminum siding allowed.
- Pets & animals: No animals, livestock, or poultry may be raised or bred on any lot. Household pets (cats, dogs) are permitted but not for commercial purposes. Dogs may not stray onto another lot without the owner's consent.
- Parking & vehicles: Vehicles must be parked on paved driveways on the owner's lot. Street parking is limited to two hours (no overnight). Visitors may not park on streets longer than 24 hours. Commercial vehicles, trailers, boats, and recreational vehicles must be stored inside a garage or concealed behind a side fence on a paved pad. Abandoned or inoperable vehicles must be removed or stored out of sight.
- Fences & walls: Fences are required along rear and side lot lines. They must be 6–7 ft tall and made of brick, cement block, or ornamental iron (gates may be wood). Side fences must match the residence's architectural style and be approved. Fences within front or side setback areas cannot exceed 2.5 ft. No fences may be placed in front utility easements. No electronic gates across streets.
- Landscaping & yard maintenance: Front yards must be landscaped with natural organic material (no desert landscaping, rock, or decomposed granite unless approved as accent). An automatic sprinkler system must be installed and maintained. The Association is responsible for seeding, watering, mowing, and maintaining front yards from the residence face to the curb. Owners maintain rear and side yards. Trash containers must be screened from view and placed out only on pickup days.
- Signs & advertising: Only one 'For Sale' or 'For Rent' sign (max 24x24 inches) is allowed on a lot. No other advertising, billboards, or unsightly objects are permitted. Developer signs are exempt until all lots are sold.
- Assessments & fees: Annual assessments are due Jan 1 and delinquent after Jan 15. The first annual assessment was $360 per lot. Rates are uniform within each area: Lexington lots pay the full rate, Concord lots pay 2/3 of that rate. A one-time $100 Deed-Restriction Enforcement Fee is paid at purchase. The Board may increase assessments up to 10% or the CPI increase each year without a vote; larger increases require a 2/3 vote. Unpaid assessments bear 15% interest and can become a lien. The Association may foreclose for nonpayment.
- Architectural & construction review: All construction plans must be approved by the Deed Restriction Review Committee (3 members appointed by the developer, later elected by the Board). Construction must be completed within 18 months; otherwise the Association may impose a $1,000/month penalty and/or remove the improvements.
