Heritage Court at Stonegate is a single-family home subdivision in Phoenix, AZ, governed by a homeowners association (HOA). You own your lot and house; the HOA maintains the front 'Yard Lot Areas' (landscaping on the street side and front courtyard) but not the house, driveway, sidewalks, or rear/side yards. The community is subject to an additional master association (Stonegate Master Association) with its own rules and assessments.
- What you own & maintain: You own your lot and all improvements on it (house, driveway, walkways, rear/side yards). You must maintain the house exterior, fences, roof, windows, doors, driveways, sidewalks, and all fixtures. The HOA maintains only the front 'Yard Lot Areas'—the landscaping on the street side of any front wall and the front courtyard. Termite control is your responsibility.
- Assessments & fees: Annual assessments cover landscaping of Yard Lot Areas, water, maintenance, reserve, and liability insurance (minimum $500,000). Initial max assessment per lot was $600/year; thereafter, the Board may increase up to 5% per year without a vote, or more with 66% member approval. Special assessments for capital improvements require 3/4 Board vote and 66% member approval. Assessments are a personal obligation and a lien on the lot, subordinate to first mortgages. Developers’ lots are exempt until occupied/sold.
- Use restrictions: Lots are restricted to single-family residences only. No temporary structures, trailers, tents, barns, or outbuildings may be used as residences. No moving buildings onto a lot. No activity that increases insurance rates or violates law. Planting in Yard Lot Areas must match original plan or be approved by the Association. Hedges or walls require approval. Individual gardening visible from other lots must be neat; no affixing anything to walls/fences without Board approval.
- Architectural review & exterior changes: No exterior modifications of any kind (including painting, planting, awnings, sunshades) may be made without Board approval. Structural changes to buildings are also prohibited without approval. Landscaping in Yard Lot Areas is limited to original plants or those approved by the Association or its agent.
- Insurance: The HOA carries insurance for landscaping in Yard Lot Areas and public liability. Each owner must carry insurance covering the full replacement cost of their residence, all lot landscaping, and other improvements. Owners may obtain additional insurance at their own expense.
- Damage and repairs: If a Yard Lot Area is damaged by an owner/guest, the owner must repay the HOA for repairs. If a house or adjacent property is damaged by any cause, the owner must repair within 30 days to original plans/specifications; if not, the HOA may do so and charge the owner. Unpaid charges become a lien (subordinate to first mortgage) and bear 18% interest. Disputes go to arbitration.
- Master association & subordination: Heritage Court at Stonegate is part of the larger Stonegate community and is subject to Stonegate Master Association's CC&Rs, Tract Declaration, and rules.
