Hillcrest Six is a single-family home subdivision in Phoenix, AZ, governed by a homeowners association (HOA). You own your lot and dwelling, and share ownership of common areas (Tracts E and F). The HOA maintains common areas and enforces rules. An amendment restricts occupancy to persons 18 years or older (no children).
- Residential use & age restriction: All lots are for single-family residential use only. No business activities. An amendment (1985) prohibits sale or regular occupancy by anyone under 18; residents must be 18 or older. Existing residents under 18 as of the amendment date are grandfathered.
- Architectural review: Any exterior alteration, addition, landscaping, or color change requires prior written approval from the Board or an Architectural Committee. The Board may disapprove for aesthetic reasons. If no decision within 30 days, approval is deemed granted.
- Pets: Only domestic dogs, cats, fish, and caged birds allowed (no livestock). A 'reasonable number' is defined as up to 2 dogs, 2 cats, and 2 birds per unit. Pets must be leashed outside; owners are fined $10 for unsanitary conditions on common property.
- Leasing & rentals: Leases must be for at least 30 days. Lessees must comply with all governing documents. Owners must give the Board a 15-day right of first refusal on any sale, lease, or rental offer (exemptions for foreclosure, original sales, and inheritance).
- Parking & vehicles: No mobile homes, trailers, boats, recreational vehicles, commercial vehicles, truck campers, or motorcycles may be kept on common areas or streets. On your lot, no vehicle may be constructed, dismantled, or repaired if visible from the street or neighbors, except emergency repairs.
- Assessments & fees: Annual assessments start at $360 per unit, adjustable up to 10% per year without a vote. Higher increases require a 2/3 vote. Special assessments for capital improvements also need 2/3 approval. Late payments incur a $10 penalty for the first 10 days plus $1/day thereafter.
- Common areas & HOA membership: Each lot owner gets an undivided 1/110th interest in Tracts E and F (common areas). Membership in the Hillcrest Improvement Association No. 2 is automatic with ownership; each unit gets one vote (developer gets three votes per owned lot until 75% of units sold).
