What Mirano at Desert Oasis's governing documents say
Mirano at Desert Oasis is a master-planned single-family community in Peoria, Arizona (106 lots), where you own your individual home and lot, and share ownership of common areas maintained by the homeowners association. All owners and occupants are bound by strict architectural review requirements and must pay ongoing assessments for community upkeep.
- What you own & maintain: You own your individual lot and dwelling unit; the association maintains common areas (landscaping, flood control, drainage, open space, recreational facilities, and utilities) funded by assessments.
- Architectural review & design control: You must obtain prior written approval from the Design Review Committee before making ANY exterior change—building, alterations, landscaping, color changes, fencing, pools, driveways, or any visible modifications. Approval is granted or denied at the sole discretion of the reviewer.
- Assessments & mandatory fees: Owners pay Regular Assessments (annual), plus Special Assessments when needed, Reserve Fund Assessment (up to 1/6 of the annual regular assessment), and Working Capital Fund Assessment (up to 1/6 of the annual regular assessment). Specific dollar amounts are set by the Board and can increase.
- Single Family definition & occupancy: A household may be persons related by blood, marriage, or legal adoption, OR up to 3 unrelated persons. Group homes, boarding houses, rooming houses, and detention facilities are prohibited.
- Voting rights & membership: Each lot owner has one membership vote in the association; voting rights are tied to lot ownership and pass to the new owner upon sale. The developer (Declarant) retains enhanced voting power and design control during the development period (through 2050 or when all units are built and conveyed).
- Easements & access: The Association has easements for inspection, maintenance, and emergency access to private lots; utility companies have easements for installation and repair; and all properties are subject to natural drainage and encroachment easements (up to 18 inches for structures, 42 inches for perimeter walls).
- What this document doesn't cover: This declaration does not specify dollar amounts for assessments, pet policies, lease/rental restrictions, or detailed design guidelines (which are in a separate Design Review Guidelines document).
