What Patriots Square's governing documents say
This document is a 2007 amendment to the governing documents for Patriots Square, a condominium (horizontal property regime) in Phoenix, AZ. It was created to allow a major redevelopment project called CityScape on the surface lot known as Patriots Park. The amendment changes rules about building heights, parking, allowed uses, and insurance for the redevelopment. It does not contain the original community rules for unit owners.
- Redevelopment & height limits: Any improvements on the surface unit cannot exceed 80 feet above original ground level. Open areas must comply with a separate 'Park Restrictions' and be landscaped. Portions of the surface unit not dedicated as public park may be used for retail, office, or residential purposes (and other uses consistent with the development agreement).
- Parking space minimums & interruptions: Redevelopment must maintain at least 316 parking spaces on Level 2 and 296 on Level 3 for the existing tenant (Ren One), plus public parking on Level 1. Temporary construction-related parking interruptions are allowed: up to 180 consecutive days for spaces not near the north stairwell, and up to 60 consecutive days (180 total) for north-side spaces. Only one ramp may be closed at a time, for up to 12 months.
- Prohibited uses: Exhibit B lists uses banned on the property, including tattoo shops, gas stations, sexually-oriented businesses, taverns selling alcohol for off-premises consumption, helistops, motels, manufacturing, mortuaries, halfway houses, pawnshops, and payday loan services.
- Insurance requirements: The developer (CityScape) must carry commercial general liability insurance with a $2 million aggregate and a $50 million umbrella policy, plus builder’s risk, auto liability, and workers' compensation. The City of Phoenix, the Patriots Square Association, and other parties must be named as additional insureds.
- What this document doesn't cover: This is only a 2007 amendment to the original Declaration. It does not include the original rules about unit ownership, assessments, pet limits, leasing restrictions, or other typical condominium policies. To understand the full set of community rules, you must read the original Amended and Restated Declaration of Horizontal Property Regime and Declaration of Covenants, Conditions and Restrictions for Patriots Square (recorded July 1, 1988) and any other amendments.
