Rio Sureno Medical/Dental Center is a commercial condominium/office park in Phoenix, AZ — you own a lot with a unit (building), sharing common areas and private roadways with other lot owners, all governed by an association. This is a first amendment to the original declaration, creating the association and adding detailed rules on maintenance, assessments, and architectural control. These rules bind the lot owners (medical/dental professionals or investors), not tenants.
- What you own & maintain: You own your lot and the unit (building) on it, including roofs, windows, doors, and structural components. The association maintains 'Association Maintenance Property' — landscaping, sprinklers, parking areas, private roadways, lighting, and the exteriors of units for painting and routine maintenance. Owners must maintain their units in a first-class appearance and promptly repair any exterior, structural, or roof damage.
- Assessments & fees: The board sets annual assessments based on projected costs, payable in equal monthly installments due by the 10th. Owners and their tenants, guests, employees have a perpetual easement to use parking spaces on individual lots, but the association may adopt rules for assigned reserved parking on a non-discriminatory basis.
- Enforcement & violations: The association can enter the property to abate violations, sue for injunctions or damages, and recover reasonable attorney's fees. A violation is declared a nuisance. Owners can enforce only if the association fails to act within 60 days of notice. The association must issue a certificate of compliance (within 15 business days) upon written request and a fee up to $50.
