Ruthgate Condominiums is a 12-unit condominium community in Phoenix, AZ. Each unit owner owns their individual unit and shares ownership of the common elements, managed by the Ruthgate Homeowners Association. The Association maintains the building and common areas, insures the structure, and charges uniform assessments per unit. Owners must follow use restrictions detailed in this Declaration.
- What you own & maintain: You own the interior space of your condominium unit (walls, floors, ceilings) and are responsible for all maintenance, repairs, and replacements inside. Structural components, exterior, and common elements are the Association's responsibility. Water is metered collectively and paid by the Association; other utilities are separately metered and paid by owners.
- Assessments & fees: Each unit pays an equal share (1/12) of the budgeted common expenses as a regular monthly assessment. The Board may also levy special assessments for violations or capital improvements up to 5% of annual expenses without owner approval. Delinquent assessments incur a late charge, interest, and a lien on the unit.
- Leasing & rentals: Leases must be in writing and for a minimum term of 30 days, prohibiting transient or hotel-style rentals. Owners cannot lease less than the entire unit and are responsible for ensuring tenants comply with all governing documents. The Association can step in to evict a non-compliant tenant at the owner's expense.
- Pets: Dogs, cats, and other household pets are allowed inside a unit, but may not be bred or kept for commercial purposes. The Board can limit the number of pets deemed unreasonable and may adopt additional pet rules. All pets must be leashed when outside the unit.
- Parking & vehicles: Each unit has an exclusive easement to a designated parking space. No vehicles over 3/4-ton capacity (e.g., large trucks, buses) may be parked without Board approval. Temporary parking for guests, deliveries, and loading is allowed. No repair work on vehicles is permitted on the property.
- Use restrictions & aesthetics: Units are for residential use only; no business or commercial activity. Signs require Board approval (except a single For Sale/For Rent sign). External fixtures like antennas, awnings, fences, or satellite dishes are prohibited without approval. Window covers are limited to curtains, drapes, or shades, subject to Board regulation. No external laundering or loudspeakers facing outdoors.
- Architectural & alteration rules: Owners may make non-structural alterations inside their unit. Structural or exterior changes are prohibited without approval. The Board must approve any temporary structures or external modifications.
