What Sunburst Farms East Two, Three, Four and Seven's governing documents say
Sunburst Farms East is a traditional single-family home community in Phoenix, Arizona, governed by an amended and restated declaration of covenants, conditions, and restrictions covering four subdivisions (Two, Three, Four, and Seven). All lots are single-family residential with a minimum ground floor area of 1,100 square feet. The homeowner association maintains shared bridle paths, easements, and a community irrigation system.
- Minimum home size: Every home must have at least 1,100 square feet of ground floor living space. Mobile and manufactured homes are not permitted.
- Animals: Horses, poultry, and livestock are allowed on lots for the owner's private use and enjoyment, subject to local ordinances.
- Association maintenance: The association maintains the bridle paths, easements, the well and irrigation system. It also carries insurance for those areas.
- Monthly dues & fees: Base dues were set at a minimum of $18 per month in 2008 and cannot decrease below that. Increases over 10% from the prior year require a 51% owner vote. A late fee of $15 or 10% of unpaid amount applies after 15 days.
- Water delivery dues (optional): Owners may choose to receive irrigation water by paying additional water delivery dues. Election is made annually by October 31.
- Transfer & capital reserve fees: Upon purchase, a new owner must pay a transfer/disclosure fee of at least $250 and a capital reserve fee of at least $250. These amounts may increase up to 10% per year.
- Lien for unpaid dues: Unpaid dues over $500 create a lien on the property. However, the board cannot foreclose on that lien; it is enforceable only at sale or refinance.
- Rules enforcement: The board can enforce rules, but cannot impose restrictions stricter than city zoning without a 51% owner vote. Disputes go to mediation then arbitration.
