Sunset Ranch is a single-family home HOA in Phoenix, AZ — you own your lot and house, and the association maintains common areas and enforces rules. This declaration governs all owners and future buyers, with restrictions on use, leasing, pets, parking, and exterior changes.
- Residential use only: Lots may only be used for single-family residential purposes; no commercial activity, but home businesses complying with local ordinances are allowed. Temporary structures like trailers or tents cannot be used as residences.
- Leasing & rentals: No lease for less than six months. Owners are responsible for tenant compliance with HOA rules. For-sale or for-lease signs are restricted; no lease signs visible from neighboring property during the first 24 months after initial sale.
- Pets: Common household pets (dogs, cats, etc.) are allowed, but types and breeds must be acceptable to the Board, and numbers must be reasonable as determined by the Architectural Committee. No commercial breeding. Pets must be leashed or fenced; structures for pets must not be visible from neighboring property.
- Parking & vehicles: Vehicles must be parked on driveways (not front yards). Inoperable or commercial vehicles with signage are not allowed if visible from neighboring property.
- Architectural review: Any exterior change (construction, painting, landscaping, fencing, etc.) requires prior written approval from the Architectural Committee. Approval is deemed given if the committee does not act within 60 days. No liability for committee decisions; owners must also obtain government permits.
- Assessments & fees: Annual assessments start after the first lot is sold; initially capped at $80/month per lot, then adjustable by the Board (max 20% increase per year without majority owner approval). Special assessments require 2/3 vote. Late fees: 10% or $15 minimum. Delinquent assessments become a lien on the property.
- Maintenance responsibilities: Owners must maintain their lot and residence in good repair, including landscaping within 90 days of purchase. The association may step in if an owner fails to maintain, charging costs as a lien. Sidewalks on the lot but used by the public are maintained by the association.
- Party walls: Walls on lot boundaries are party walls shared equally with neighbors. Each owner maintains their side; repair costs are shared unless one owner causes damage. Any modification requires adjoining owner's consent.
