It governs the relationship between the residential condominium portion and the ground-floor commercial property. Unit owners should review their condominium declaration for rules on pets, leasing, and unit modifications — this document focuses on shared infrastructure, services, and cost-sharing between the two property types.
- Reciprocal easements: The condominium and commercial properties grant each other perpetual easements for structural support, utility access, ingress/egress, and maintenance. The commercial property can use common elements like the lobby, elevators, and loading dock, while the condominium has easements for access and support across the commercial space.
- Services provided by condo association: The condominium owner (association) must provide services to the commercial property, including roof/facade maintenance, window cleaning, exterior lighting, landscaping, chilled water, elevator service, and sidewalk upkeep. Costs are allocated per agreed terms, and failure to perform allows the commercial owner to step in and seek reimbursement.
- Insurance requirements: Both owners must maintain 'all risk' property insurance at 100% replacement cost, with building ordinance coverage of at least $1,000,000. - Tax allocation: Until separate tax parcels are assigned, taxes are split 97.35% to the condominium and 2.65% to the commercial owner. Each owner pays its share of real estate taxes on its respective portion.
- Maintenance and repair responsibilities: The commercial owner maintains its property and facilities within its space. The condominium owner maintains common elements and systems serving the commercial property. If damage affects both, repair is joint. Each owner is responsible for costs from damage they cause.
- Structural support: No owner may act that compromises structural safety. If structural support is needed, the responsible owner (or the benefiting owner if cause is undetermined) must pay for construction. Disputes go to arbitration.
- Dispute resolution and liens: Unpaid sums or breached covenants allow the other owner to place a lien on the defaulting owner's property (subordinate to mortgages). If the condominium is subject to the Condominium Act, unit owners have individual liability capped by their common-element percentage.
- What this document doesn't cover: This document does not contain rules for unit owners regarding pets, leasing, noise, parking, or architectural changes. Those are governed by the separate Condominium Declaration and bylaws. It also does not set assessment amounts or age restrictions.
