The Winds of Tatum is a standard single-family home HOA in Phoenix, AZ, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) that apply to all lot owners. Built as part of a 120-lot subdivision, the rules cover assessments, property maintenance, architectural control, and residential use restrictions to protect property values.
- Assessments & fees: Annual assessments start at a maximum of $300 per lot, adjustable each January based on the Consumer Price Index or by a two-thirds vote of members. Special assessments for capital improvements also require a two-thirds vote. Assessments are uniform per lot, can be collected monthly, and delinquent amounts accrue 12% interest. The association may file a lien or sue for unpaid assessments.
- Architectural control: No building, fence, wall, or other structure may be erected, altered, or repainted without prior written approval from the board or an appointed architectural committee. Plans must be submitted showing color, materials, and location; if no decision is made within 30 days, approval is deemed granted.
- Property maintenance: Each owner must keep their lot (including buildings and landscaping) in good condition, free of trash and unsightly objects. The association maintains front yards and privacy walls. If an owner fails to maintain after 30 days' written notice, the association may enter and perform the work, charging the cost to the owner as an assessment.
- Use restrictions: All lots are for residential use only; no business, noxious activities, or nuisances allowed. No temporary structures (trailers, motor homes, tents) may be used as dwellings. No animals for commercial purposes; only dogs, cats, or other household pets are permitted. No signs larger than 5 square feet, except for one sale/rent sign.
- Parking & vehicles: No overnight street parking is allowed. No trailers, boats, commercial vehicles, motorhomes, or similar items may be kept on any lot if visible from neighboring property, except during emergency repairs or approved construction. The association may tow violating vehicles and charge the owner.
- Dwelling size & setbacks: Any dwelling must have a ground floor area of at least 650 square feet (exclusive of porches and garages). Front setbacks are at least 15 feet; side street setbacks at least 10 feet; interior side setbacks at least 5 feet. Owners of adjoining lots may build closer to the common lot line if both lots are under common ownership.
