Thomas And Hayden Office Condominiums is a commercial condominium project in Phoenix, AZ — you own your individual office unit and a share of the building's common elements. The association maintains the common areas, carries master insurance, and enforces architectural and use restrictions. Residential use is prohibited; the project is intended for office and other S-R zoning permitted uses.
- What you own & maintain: You own the interior of your unit (including interior walls, floors, ceilings, and your HVAC system). The association maintains the exterior walls, roof, common elements, and landscaping, and carries master property and liability insurance.
- Permitted uses (commercial only): Units may only be used for purposes allowed by City of Scottsdale S-R zoning. No residential use is permitted. No noxious, offensive, or hazardous activities are allowed.
- Architectural review: Any exterior alteration, addition, or sign requires prior written approval from the Board of Directors. Plans must be submitted, and the Board has up to 30 days (with possible 30-day extension) to approve or disapprove. Fees may be charged for review.
- Parking & vehicles: Adequate on-site parking must be provided; no on-street parking should be needed. Parking spaces shown on the plat are limited common elements assigned to specific units. Truckwells (loading docks) are common elements and may not be used by one owner for more than 90 minutes. Vehicles creating noise or unsightly conditions may be prohibited.
- Leasing & rentals: The declaration does not restrict leasing terms or require minimum lease duration. Owners may lease their units; however, tenants must comply with all rules. Signs for lease or sale require Board approval.
- Assessments & fees: Annual assessments are based on each unit's undivided interest in common elements. Special assessments require 60% owner vote. A reserve contribution of $0.50 per square foot is due from each new owner. A transfer fee of $250 is due from each purchaser. Late payments incur 5% late fee and 18% annual interest. Unpaid assessments become a lien on the unit.
- Insurance: The association maintains a master property policy covering common elements (replacement cost) and liability insurance of at least $1M per occurrence/$2M aggregate. Owners are responsible for insuring their own unit improvements, personal property, and liability. Deductibles may be assessed to an owner if caused by their negligence.
- Damage & reconstruction: If less than 75% of the project is destroyed, repair is required unless 80% of owners and every affected owner vote not to rebuild. If 75% or more is destroyed, repair must begin within 100 days unless 80% of owners and every affected owner vote to terminate. Special assessments cover insurance shortfalls.
