Cortese Condominium is a 10-unit condominium community in Scottsdale, AZ – you own your individual unit plus a 1/10 undivided interest in the common areas, with the association managing and maintaining the common elements. This governing document is the full declaration and is binding on all unit owners.
- What you own & maintain: You own the interior space of your unit (including windows, doors, and electrical outlets in perimeter walls) and an undivided 1/10 interest in the common area. The association maintains all common areas, including parking, driveways, roofs, structural walls, and central utility systems.
- Leasing & rentals: Leases must be for at least 20 days – no transient or hotel use. Short-term rentals under 20 days or those providing hotel-like services (e.g., daily maid service) are prohibited. Leases must comply with the declaration and association rules.
- Pets: Dogs, cats, or birds may be kept only with prior association approval. The board may set rules and can require removal of any pet deemed objectionable. Approval cannot be unreasonably withheld.
- Vehicle restrictions: No trailers, campers, mobile homes, commercial vehicles (except standard pickup trucks with unobtrusive signage), inoperable vehicles, boats, or off-road vehicles may remain on the property unless enclosed in a garage or designated area. Noisy or smoky vehicles prohibited.
- Architectural review: No exterior alterations, additions, or landscaping visible from the street or common area may be made without prior written approval from the Architectural Control Committee. Plans and specifications must be submitted for review.
- Occupancy limits: Maximum number of residents: two-bedroom unit – 6 persons; four-bedroom unit – 8 persons. Additional short-term guests are allowed for reasonable periods.
- Assessments: Annual assessments initially capped at $600 per unit, subject to increase (or decrease) of up to 20% per year without a 51% vote of non-declarant members. Special assessments up to 5% of budgeted expenses may be levied without a vote. Assessments are a lien on the unit and a personal obligation.
