Cabo Del Oro is a standard single-family home HOA in Scottsdale, AZ. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) applies to Lots 1-8 and binds all current and future owners. It establishes the Cabo Del Rey Homeowners Association to manage common areas (buffer walls, landscaping) and sets rules on assessments, architectural design, property use, and maintenance.
- Assessments & fees: Annual assessments start at $300 per lot and may increase up to 10% per year without a vote. Special assessments require a two-thirds vote of each membership class (owners and declarant). Delinquent assessments accrue 12% annual interest and create a lien on the property, but the lien is subordinate to first mortgages.
- Architectural review: All new buildings, exterior changes, fences, and walls must have written approval from the Board or an architectural committee. Plans are deemed approved if no decision is made within 30 days. Homes must be of Southwestern architectural style with a two-car garage. Minimum living area is 2,950 square feet.
- Use restrictions: Prohibited: shake, metal, concrete tile, and composition roofs; wood, plastic, aluminum, or asbestos siding. Boats, trailers, and motor homes cannot be stored in front or side yards or visible from streets. No direct vehicular access to Cholla Street. Horses and farm animals are not allowed. Landscaping must be completed within four months of construction and kept in good condition; dead plants replaced within 30 days. Height limit: 24 feet above mean lot elevation, maximum one story (excluding lofts).
- Maintenance responsibilities: The Association maintains common facilities (buffer walls along 96th and Cholla Streets, including landscaping and irrigation). Owners must maintain the interior side of buffer walls on their lots. The Association also maintains a decorative paved section of 95th Street as required by the city, subject to future change.
- Amendment & term: The CC&Rs run for 20 years from recording (1986), then auto-renew for 10-year periods. Amending during the first 20 years requires 90% of lot owners' approval; after that, 75% is needed. Any amendment must be recorded.
