What Cabo Del Rey's governing documents say
Cabo Del Rey is a single-family home subdivision in Scottsdale, AZ, governed by a homeowners association (HOA). These Covenants, Conditions & Restrictions (CC&Rs) apply to all lot owners and set rules for construction, maintenance, and use of the properties.
- Architectural control: All new construction, exterior changes, fences, and walls must be approved in writing by the board or an architectural committee. Residences must be at least 2,950 sq ft, have a garage for two cars, and be of southwestern architectural style. Height is limited to 24 feet above mean elevation, no more than one story (excluding lofts). Prohibited materials include shake roofs, corrugated plastic/sheet metal, concrete tile, composition roofs, and siding made of wood, plastic, aluminum, or asbestos. Permitted roofs: clay tile, concealed built-up, or committee-approved. Exteriors must be stucco, plaster, or other approved hard masonry.
- Assessments & fees: The HOA charges annual assessments (initially max $240 per lot per year, adjustable up to 10% annually without a vote) and may levy special assessments for capital improvements with a 2/3 vote of each membership class. Assessments are a continuing lien on the lot and a personal obligation of the owner. Interest accrues at 12% per annum on unpaid amounts. The lien is subordinate to first mortgages. Assessments are uniform for all lots.
- Use restrictions: No boats, trailers, or motor homes may be stored on lots unless shielded from view from any street or other lot, and never in front or side yards. No vehicular access directly from a lot onto Cholla Street. No horses or farm animals. Landscaping in front yards must follow an approved plan and be completed within four months of residence construction; dead plantings must be replaced within 30 days.
- Common facilities: The HOA maintains buffer and perimeter walls, landscaping, and irrigation along 96th Street and Cholla Street. Owners have an easement to use these common facilities, subject to the HOA's right to dedicate them to a public agency with a 2/3 vote. Interior buffer wall maintenance is the responsibility of the owner on whose lot the wall is located.
