What Desert Cove Dental Plaza Condominium's governing documents say
Desert Cove Dental Plaza is a professional office condominium in Scottsdale, AZ — you own an individual office unit and share ownership of the building structure and common areas, which the association maintains and insures. This is a business-use property, not residential; all units are restricted to professional and office purposes only.
- What you own & maintain: You own your office unit interior (walls, windows, ceilings, floors, fixtures, and HVAC system serving that unit). The association maintains the building exterior, roof, common mechanical rooms, parking areas, driveways, and landscaping, funded by common expense assessments.
- Professional office use only: Units are restricted to professional and office-related activities only; no residential use, temporary structures, or noxious activities are permitted. Violating use restrictions can result in the association taking legal action to enforce compliance.
- Architectural & design review: Any exterior modifications, signage, additions, or substantial changes require written Board approval. Design standards require reinforced concrete or masonry construction, coordinated colors and materials, underground utilities, screened roof-mounted equipment, and materials consistent with the existing building aesthetic.
- Parking & vehicle standards: All parking areas and driveways must be paved; adequate off-street parking is required to accommodate business operations without using adjacent streets. The Board can prohibit any vehicle it determines is creating loud or annoying noise, is unsightly, or detracts from the project's character.
- Common assessments: All owners pay proportional common expense assessments based on their undivided interest in common elements. Assessments cover management, insurance, real property taxes, maintenance, utilities, legal and accounting fees, and reserves for major repairs and replacement of building systems.
- Association access & rights: The association has the right to enter units during reasonable hours for maintenance, repair, and emergency work affecting common elements or to prevent damage, with as little inconvenience as practicable. Any damage caused by such entry is repaired at the association's expense.
- Governance & membership: All unit owners are automatically members of the association. Initially, the developer (LGE Corporation) appoints all board members; this control transfers to owner-elected directors after 4 years or when 75% of units are sold. The board of directors then has 4 members, one representing each unit owner.
