What The Manors of Scottsdale's governing documents say
The Manors of Scottsdale is a seniors-only (62+) retirement community in Scottsdale, Arizona. You either purchase title to your unit (subject to the Declarant's 120-day repurchase option triggered by your death, relocation, or sale) or lease it annually; either way, the Declarant owns all common areas and has broad control over operations and resident placement. This is not a condominium—you have no ownership interest in shared facilities.
- Age restrictions: At least one resident per unit must be 62 or older. Nobody under 25 may live there. People 25–62 may reside only if Board-approved as a health-care worker or assisted-living resident for a 62+ resident, and must pay an additional monthly fee.
- Ownership vs. lease programs: Titled Ownership: You buy title to your unit, but the Declarant can repurchase it within 120 days if you die, are deemed unsafe, or list it for sale; the repurchase price is your original cost minus repairs, an 8.5% deduction, and unpaid fees. Annual Lease: You rent for 12 months, terminable for default, death, incapacity, or if you're deemed a safety risk.
- What you own & don't own: You own your unit's interior (walls, floors, fixtures, furnishings). The Declarant owns all common areas—corridors, elevators, dining, pool, spa, therapy rooms, parking, landscaping. You maintain your unit interior; the Declarant maintains common areas and building exterior. This is explicitly not a condominium.
- Monthly occupancy fees: You pay a monthly occupancy fee for your unit plus access to all Declarant facilities; an additional fee applies per extra occupant. The Board may adjust fees based on unit type and service costs.
- Pets: Pets (dogs or cats) allowed only in first-floor units, maximum one per unit, with dogs limited to 10 pounds. No pets allowed above the first floor. All pets must be leashed on common areas, and pet owners are fully liable for damage, noise, or injury caused by their pet.
- Restrictions on interior & exterior: You cannot paint, tile, carpet, or modify your unit's interior, or install window air conditioners, antennas, or satellite dishes without Declarant approval. Prohibited on the property: barbecues on patios, clotheslines, exterior speakers, vehicle repairs, mobile homes, RVs, boats, or trailers.
- Safety determinations & forced moves: The Declarant may unilaterally determine that a resident poses a safety risk and require custodial services; if refused, the resident may be relocated to a safer environment in coordination with the Board and family.
