What Capistrano at Scottsdale Vista North Association's governing documents say
Capistrano At Scottsdale Vista is a planned unit development (PUD) of townhomes in Scottsdale, AZ. This governing document binds all current and future owners, residents, and tenants. It defines the association, common areas, assessments, and property use restrictions, including leasing, pets, parking, and architectural review.
- What you own & maintain: You own your lot and townhome interior. The association maintains common areas, exterior painting, and some landscaping. You are responsible for roofs, exterior walls (except painting), windows, private yards, patios, and pest control.
- Assessments & fees: Annual assessments are levied uniformly per lot, initially capped at $648/year (as of 1985), with annual increases up to 5% without membership vote. Special assessments for capital improvements require 2/3 vote of each membership class. Late payments incur 6% interest and a late charge, and the association may foreclose on the lot.
- Leasing & rentals: Leases must be in writing, for any term, and the tenant must agree in writing to comply with all governing documents. A lease violation constitutes a default under the lease.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes and not in unreasonable numbers. No animals or fowl that are annoying or noxious are permitted.
- Parking & vehicles: No vehicles of any type (including boats, campers, bicycles) may be parked in common areas. Inoperable or abandoned vehicles may not be stored on lots or common areas where visible from other lots or streets. The board may restrict parking and tow violators.
- Architectural review: No exterior structures, alterations, fences, or changes may be made without prior written approval of the board or architectural committee. Plans are considered approved if no decision within 30 days of submission.
- Party walls: Walls built on lot dividing lines are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall. Disputes are settled by arbitration.
- Use restrictions & nuisances: Lots are for residential use only. No business activities, commercial signs (except one small for sale/lease sign), temporary structures, or nuisances. Clotheslines, garbage, and storage must be screened. No exterior antennas without approval.
