Saguaro Ridge Estates is a single-family home community (26 lots) in South Tucson, AZ, governed by a Homeowners Association (HOA). This Declaration of Covenants, Conditions and Restrictions (CC&Rs) is the primary rulebook binding all lot owners, their tenants, and guests. It sets rules on property use, architectural control, leasing, assessments, and HOA governance.
- Architectural review: All exterior changes (construction, painting, landscaping, etc.) require prior written approval from the Architectural Committee. Requests are deemed denied if not acted on within 45 days. A deposit may be required for new main structures. The Committee can impose rules more restrictive than local codes.
- Leasing & rentals: Leases must be for the entire lot (no rooms or casitas) and for a minimum term of 30 days. Tenants must be a single family (defined as related persons or up to 3 unrelated individuals living together). Leasing is allowed but subject to all governing documents.
- Residential use & home businesses: All units must be used only as a single-family residence. Home businesses are allowed only if not detectable from outside (sight, sound, smell), comply with zoning, and don't disrupt the residential character. Leasing is not considered a business.
- Assessments & fees: Annual assessments are levied per lot, with a maximum 20% increase without majority vote. Special assessments require 67% member approval. Lot-specific assessments cover costs for owner-caused violations. Transfer, refinance, and disclosure fees may be set by the Board. All unpaid amounts become a lien on the lot.
- Association rules & enforcement: The Board can adopt, amend, or repeal rules on various topics (e.g., parking, noise, signs, antennas, vehicles, garbage). Violations can result in fines after notice and a hearing. Voting rights may be suspended for delinquent or noncompliant owners.
- Common area & easements: Owners and tenants have easements to use common areas (private streets, open spaces) subject to regulations. The Association can suspend access for delinquent or violative owners. Utility easements and Declarant's sales/construction easements also exist.
- Declarant control & transition: The developer (Declarant) controls the Board and Architectural Committee until 90% of lots are sold, the Transition Date (20 years max), or voluntary surrender. Declarant has special voting rights (3 votes per lot owned) and reduced assessment rates on unsold lots.
