Huntington Palms Condominiums is a 36-unit condominium community in Tempe, Arizona, where you own your individual unit and share ownership of the common elements (building exterior, roof, grounds, parking, and swimming pool facilities). Unit owners automatically become Association members, contribute to a shared assessment fund, and are subject to strict architectural approval and use restrictions.
- What you own & maintain: You own your unit's interior (wall to wall) plus an undivided 1/36 share of all common elements. The Association maintains the building exterior, roof, landscaping, parking, and recreation facilities; you are responsible for your unit's interior, refrigeration unit, and termite control.
- Assessments & fees: You pay 1/36 of common expenses monthly: maintenance, recreation, reserves, and liability insurance (minimum $500,000 policy). The initial maximum annual assessment is $960 per unit ($80/month). The Board can raise it up to 10% yearly; larger increases require a majority member vote. Unpaid assessments are delinquent after 20 days and accrue 10% annual interest as a lien on your unit.
- Leasing & rentals: You may lease your unit to others, but only for terms of at least 30 days. Transient or hotel-style rentals (with maid service, room service, or similar hotel amenities) are prohibited.
- Pets: Commonly accepted household pets are allowed.
- Use restrictions: Your unit is restricted to single-family residential use, one story only. No business, commercial, religious, or institutional use is permitted. Visible clotheslines, trash burning, antennas, and athletic equipment (e.g., basketball hoops) are prohibited. Signs are not allowed except a single 18"×24" 'For Sale/Rent' sign displayed inside a window.
- Architectural review: All improvements, alterations, and additions require the Association's prior written approval. The Association may deny approval for aesthetic or other reasons and considers harmony with surrounding units. Approval is automatically granted if the Association does not respond within 30 days. You cannot increase your unit's square footage beyond its original size.
- Party walls & shared responsibility: Walls between adjoining units are shared. If you or your guests damage a party wall, you must repair it at your expense. If damage results from other causes, the Association bears the cost. Disputes are resolved through binding arbitration with three arbitrators.
- Voting rights & membership: You automatically become a member with one vote per unit upon purchase. Your voting rights are suspended if you fall 15 or more days behind on assessments. The developer initially has special Class B voting (7 votes per unit), converting to Class A (one vote) after three years or when Class A votes equal Class B votes, whichever comes first.
