Indian Bend Gardens is a planned single-family residential community with party walls, governed by a homeowners association. Owners own their lot and home; the association manages common areas, enforces rules, and collects assessments. This document is the full Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies to all owners and residents.
- What you own & maintain: You own your lot and single-family residence (minimum 800 sq ft). The association maintains common areas and structural maintenance areas (roofs, gutters, exterior walls, landscaping in certain zones). Owners must keep their property in good repair, including lawns and plantings, and may not alter exterior appearance without architectural committee approval.
- Architectural review: Any improvement, alteration, or change to exterior appearance (including paint, fences, antennas, basketball standards) requires prior written approval from the Architectural Committee. The committee can reject plans for aesthetic or other reasons.
- Parking & vehicles: Boats, recreational vehicles, trailers, campers, and inoperable vehicles must not be visible from neighboring property unless stored in designated areas. Garages shall be used only for parking and storage. Motorcycles and motor-driven vehicles (except lawn equipment) prohibited on walkways.
- Pets: Only a reasonable number of generally recognized house pets allowed, kept for non-commercial purposes. No animals that cause unreasonable noise or nuisance. Structures for animal care must not be visible from neighboring property. Board determines whether pet is a house pet or if number is reasonable.
- Leasing & rentals: A lot (with improvements) may be rented only to a single family. No portion of a lot may be rented separately. All lease terms subject to Declaration provisions.
- Signs: No signs visible from neighboring property except: required legal signs, up to two residential ID signs (max 72 sq in each), one construction sign (max 3 sq ft), and signs approved by Architectural Committee.
- Assessments & fees: Annual and special assessments levied per lot. Initial maximum monthly assessment $33.60 per improved lot owned by non-declarant. Assessments fund common area maintenance, insurance, and community facilities. Delinquent assessments become a lien on the property and personal obligation of the owner.
- Use restrictions: Property used exclusively for single-family residential purposes. No gainful occupation, no temporary structures used as residence, no machinery except usual residential equipment. No subdivision of lots without board approval.
