Empire Vista is a single-family home community in Tucson, AZ, governed by a homeowners' association (HOA). All 153 lots and common areas are subject to this Amended and Restated Declaration, which sets forth covenants, restrictions, and easements that run with the land. Owners and occupants are bound by these rules, which cover architectural review, property use, assessments, and maintenance.
- Architectural review & landscaping: Prior written approval from the Reviewing Authority (initially Declarant, later an ARC) is required for any exterior improvements, including construction, grading, landscaping, color changes, fences, and satellite dishes. The ARC Guidelines interpret and supplement this Declaration. Variances may be granted.
- Permitted uses & restrictions: Lots are for single-family residential use only — defined as persons related by blood/marriage/adoption or up to three unrelated persons. Nuisance uses (odor, noise, etc.) and illegal activities are prohibited. No rooming houses, boarding houses, or group homes (except those protected by law).
- Assessments & liens: Annual assessments are levied by the Board to cover common expenses. Special assessments may also be imposed. Assessments create a lien on the lot. Delinquent amounts incur interest and collection costs. Working capital fund and transfer fees may be charged.
- Maintenance obligations: Each owner is responsible for maintaining their lot, including the dwelling, walls, roof, and utility lines to the point of service connection. If an owner fails to maintain, the Association may enter and repair, charging the cost as a maintenance assessment.
- Common area use & rights: Owners have a non-exclusive easement to use common areas; occupants have a revocable license. The Association may suspend use rights for up to 60 days for rule violations, or longer for delinquent assessments. Guests may be limited. Common areas can be conveyed or resubdivided with owner votes or by Declarant.
- Enforcement & disputes: The Association may enforce rules through fines, suspension of privileges, and legal action. An alternative dispute resolution process is provided. Owners may appeal ARC decisions to the Board, but no appeal is allowed while Declarant appoints ARC members.
