What Queens Homeowners Association's governing documents say
Queens Homeowners Association is a single-family home subdivision in Fruita, CO. You own your lot and house, and you must maintain the exterior, landscaping, and fences. The association maintains a common park area (Tract A) and an irrigation system. This declaration governs all lots in Queens Subdivision.
- What you own & maintain: You own your lot and must maintain the interior, exterior, landscaping, and any fence. The association maintains the common area (Tract A) and the irrigation system, and carries master insurance.
- Architectural review: Any exterior change, including construction, remodeling, landscaping, or fence installation, requires prior written approval from the Architectural Control Committee (ACCO). Submit two sets of plans; if no response within 30 days, the plans are deemed approved. Fences cannot exceed 6 feet tall.
- Assessments & fees: Annual assessments start at a maximum of $50 per lot. Each year, the maximum can increase automatically by the greater of 10% or the CPI increase. The board can set a lower actual assessment. A two-thirds vote of members can approve a higher increase. Unpaid assessments accrue interest up to 21% per year and become a lien on the lot.
- Allowed uses & structures: All lots are for residential use only. Only one detached single-family dwelling per lot, with a minimum of 1,100 square feet of first-floor living space (excluding garage, porch, etc.). No mobile, modular, or manufactured homes. No temporary structures used as residences. No mining or hazardous activities.
- Pets: Dogs, cats, and other household pets are allowed but not for commercial breeding or keeping. Pets must be controlled, leashed when outside, and not run at large or become a nuisance.
- Parking & vehicles: Each dwelling must have covered parking for at least two cars. Driveways must be paved with asphalt or concrete. Recreational vehicles (snowmobiles, ATVs, etc.) may not be operated within the subdivision, only used to reach public roads.
- Leasing & rentals: You may lease your lot to a tenant, who then has the right to use the common area. The document sets no minimum lease term; terms are governed by the bylaws.
- Signs: No signs or advertising are allowed except one 'for sale' sign per lot, no larger than 18 by 24 inches, and political signage subject to regulation by the ACCO and the City of Fruita.
