The Retreat at Seabranch is a single-family home HOA in Stuart, Florida. This document is a partial amendment to the full Declaration of Covenants, Conditions and Restrictions — it only changes two specific rules: 1) driveway maintenance responsibilities, particularly for paver or coated driveways, and 2) leasing terms and a new capital contribution fee for new owners. It does not contain the community's complete rules.
- What you own & maintain: Owners must maintain their unit, parking areas, and the portion of their driveway on common area. If you have a paver driveway, you must keep the pavers level and free of trip hazards from the garage door to the concrete Miami gutter. If your driveway is coated or sealed, you must apply and maintain a slick-resistant coating on the entire paver portion, including any part within the road right-of-way owned as common area.
- Leasing & rentals: Lease agreements must be in writing, have a term of at least four months, and require the lessee to follow all HOA rules. Owners must provide a copy of the lease to the board before the tenant moves in. If the lease doesn't say otherwise, the owner delegates their common-area rights to the tenant during the lease term.
- Capital contributions (new owner fee): Any new owner who buys a unit after the effective date of this amendment (December 2017) must pay the association a one-time fee equal to one quarter of the annual base assessment for that unit. This fee is non-refundable and not an advance payment of regular assessments; it goes into a fund for unexpected expenses or improvements.
- What this document doesn't cover: This is only an amendment to three specific sections of the full declaration. It doesn't include the community's general rules on architectural control, parking, use restrictions, assessments, or other common HOA topics.
