It creates a homeowners' association (HOA) that all property owners automatically join and binds every lot owner, resident, tenant, and guest to the rules. The document sets up the HOA's authority to levy assessments, enforce architectural standards, and impose restrictions on lot use, parking, pets, and more.
- HOA membership & voting: Every lot owner automatically becomes a member of the Oak Chase Home Owners' Association. Each lot gets one vote, and new owners must notify the association within 30 days of purchase to attend an orientation meeting and receive a Certificate of Membership.
- Assessments & fees: All lot owners must pay annual and special assessments. The annual assessment is set each year by the board based on the budget, and special assessments for capital improvements require a majority member vote (except for emergencies or government requirements). - Parking & vehicles: No commercial vehicles, boats, trailers, RVs, or disabled vehicles may be parked or stored outside a garage unless the HOA designates spaces. On-street parking is prohibited except for board-approved events. Vehicle repairs are only allowed in emergencies and must be completed within two hours.
- Use restrictions & nuisances: Lots may not be used for businesses (except quiet home offices), mining, or subdividing. No antennas, satellite dishes, clotheslines visible from the front, or temporary structures are allowed without HOA approval. Garbage must be in screened containers, and no offensive activities that constitute a nuisance are permitted. Fines up to $100 per day may be imposed for violations.
