The Pines of Avon is a single-family home subdivision in Danville, Indiana, governed by a homeowners' association (HOA). These restrictions run with the land and apply to all current and future owners, covering how you may use, build on, and maintain your lot.
- Land use & housing: Every lot is for single-family residential use only. You must build a single-family house with a minimum 2-car attached garage. Minimum living space is 1,300 sq ft for a ranch or 1,550 sq ft for a two-story (800 sq ft on the main level). No used structures or detached garages are allowed.
- Construction & exterior approval: Any new building, fence, or exterior change needs prior written approval from the Development Control Committee. Submit three sets of plans; the committee responds within 30 days. The front elevation of the first floor must be at least 70% brick. Fences are limited to 4 ft tall (pre-approved types include black vinyl chain link or shadow box; 6 ft privacy fences only around in-ground pools or back patios, max 40x20 ft).
- Maintenance & landscaping: You must keep your lot and improvements clean, mowed, and free of debris and dead trees. Within 45 days of finishing a house, landscape front yard with at least 2 trees (1.5 in caliper) and 5 shrubs (18 in tall). Front yards must be sodded; side/rear may be sod or seed. You must install a dusk-to-dawn yard light (min 120W, 2 ft behind right-of-way, 5 ft from driveway).
- Parking & vehicles: No campers, trailers, boats, or trucks 1 ton or larger may be parked overnight on streets or lots unless hidden from neighbors' and drivers' view. All driveways must be paved with asphalt or concrete.
- Pets, nuisances & signs: Only usual household pets are allowed; they must be confined so as not to be a nuisance. No noxious activities; no signs except real estate sales signs. No exposed antennas, and no satellite dishes larger than 20 inches in diameter without committee approval.
- Assessments & fees: Each lot owner must pay an annual assessment of $50 (adjustable by the Board) plus possible special assessments for capital improvements or operating deficits. Unpaid assessments become a lien on the property and incur 12% annual interest, plus collection costs and attorney's fees.
- Leasing & rentals: No short-term or vacation rentals are addressed. The document does not set minimum lease terms or restrict the number of rental properties—check for later amendments or separate rules.
- Duration & amendments: These restrictions run until January 1, 2080, and automatically extend every 10 years unless changed by a two-thirds vote of lot owners.
