Jefferson Place is a condominium community in Fort Wayne, Indiana — you own your individual unit and share ownership of the common elements. The rules here are a code of by-laws and several amendments. As of 2019, all units must be owner-occupied except for a handful that were already rentals before November 2014; new rentals are banned. The association handles maintenance of common areas, exterior insurance, and budgeting.
- Owner occupancy & renting: As of a 2019 amendment, no unit may be used as a non-owner-occupied rental except those that were already registered as rentals before November 5, 2014. If that pre-2014 owner sells, the unit must become owner-occupied. There is no minimum lease term because new leases are not permitted.
- Use restrictions & residential character: All units are for single-family residential use only. No commercial, religious, or educational activities are allowed. No boats, campers, trailers, buses, trucks, mobile homes, motorcycles, or minibikes may be parked or stored on the property unless completely enclosed in a garage. Signs (including for-sale and for-rent signs) require board approval, except for a licensed Realtor's sign up to 30x36 inches.
- Pets: Only small pet dogs, cats, or customary household pets (not bred or kept for commercial purposes) are allowed. Pets must be on a leash and attended outdoors; tethering is not considered 'attended.' Owners must clean up after pets and are liable for any damage. The board can require removal of a nuisance pet on 5 days' notice.
- Assessments & fees: Regular (annual) assessments are set by the approved budget and paid quarterly (Feb 1, May 1, Aug 1, Nov 1), though owners may pay semi-annually or annually in advance. The board may levy special assessments up to $500 per unit per year without owner approval. Unpaid assessments accrue 10% annual interest and become a lien enforceable by foreclosure. The association may deny use of the bathhouse, pool, and tennis facilities to any unit with delinquent assessments.
- Unit maintenance & owner responsibilities: Owners must maintain everything inside their unit, including water/gas/electrical lines, appliances, HVAC, doors, windows, screens, lamps, grouting/caulking, and all other accessories. The association maintains common areas, limited common areas, exterior walls, roofs, landscaping, streets, parking, sidewalks, and snow removal.
- Insurance: The association carries a master fire and extended-coverage policy for the full replacement cost of each unit, plus liability insurance. The premium for fire/coverage is split: 40% paid by the association as a common expense, and 60% paid by owners in proportion to their unit's square footage. Owners may buy additional coverage for personal property.
- Architectural & exterior changes: No signs, awnings, canopies, shutters, antennas, or other attachments may be placed on exterior walls or roofs without board consent. Nothing may be hung outside windows. No trees, landscaping, or gardening in common areas without board permission. A yardlight may be installed within 20 feet of the curb, maintained by the owner.
- Governance & meetings: The association is governed by a board of 3–9 directors, each serving staggered 3-year terms. Annual owner meetings are held in January. Owners receive 10 days' written notice. Each unit has one vote; proxies allowed. Quorum is 33% of votes. The board may adopt rules and regulations by majority vote.
