What Forest View Homes Association's governing documents say
Forest View is a standard single-family home HOA in Olathe, KS, binding all owners, occupants, and lessees. This Declaration of Restrictions, recorded in 2005 and amended in 2012, runs with the land and sets detailed rules for the use, appearance, and maintenance of lots.
- Leasing & rentals: Leases must be for at least six months and in writing; the owner is responsible for the renter's compliance with all restrictions and association rules.
- Pets: No more than three dogs or cats (or combination) per lot. Animals cannot be kept for commercial purposes, and the board can require removal of any animal deemed a nuisance or safety hazard.
- Parking & vehicles: No school bus, camper, RV, boat, or truck over 3/4 ton may be parked outside for more than 24 hours. All such vehicles must be stored in a garage. No major vehicle repair outside the garage. Inoperable, unregistered, or unsightly vehicles are prohibited.
- Architectural review: All construction, alterations, fences, decks, swimming pools, basketball goals, playground structures, and signs require prior written approval from the Architectural Control Committee (ACC). The ACC has absolute discretion and considers design, materials, colors, and harmony with the neighborhood.
- Fencing: Fences must be wrought iron or other metal approved by the ACC, not exceeding 48 inches in height unless specifically approved. Location must follow property lines unless otherwise approved. Cedar fencing was removed by the 2012 amendment.
- Building & lot standards: Only single-family detached homes are allowed, with a minimum 1,800 square feet of finished floor area. Lots cannot be subdivided. Height is limited to three stories. Setbacks: 25 feet from street lot line, 5 feet from interior lot lines (or city requirement, whichever is stricter).
- Landscaping & maintenance: Lawns must be kept mowed (grass under 6 inches), noxious weeds controlled, and litter removed. The association may cut grass/remove weeds and bill the owner. Trees and shrubs must be maintained per good forestry practices. All lots must be fully sodded unless the ACC agrees otherwise.
- Prohibited uses & structures: No home businesses with customer visits, no day care, no storage buildings, no above-ground pools, no solar panels, no exterior clotheslines or flagpoles, no artificial vegetation. Holiday decorations only from November 15 for 60 days. No hunting or firearms. No oil/fluid storage tanks.
