What Benson Place Homes Association's governing documents say
Benson Place is a master-planned community in Kansas City, MO with a mix of single-family homes, attached patio homes, attached townhomes, and villas. This is the Twenty-Fourth Supplement to the Declaration, which adds a new section of villa lots (Villas) to the community and sets specific rules for those villa owners. The supplement binds all future villa owners and updates the overall community rules to include a fifth class of membership (Class E Members) for villa owners.
- What you own & maintain (Villas): Villa owners own their unit and lot, and are responsible for the exterior and interior of their villa—including roofs, walls, foundations, windows, doors, garage doors, porches, patios, decks, driveways, sidewalks, and all utility lines on their lot. You must maintain these at your own cost.
- Services the association provides (Villas only): The association provides lawn care (mowing, edging, fertilizing, weed control, trimming/replacing trees and shrubs shown on an approved landscaping plan) and sprinkler system operation/maintenance. Snow removal from your driveway and the front sidewalk is provided for any snowfall over 2 inches. Ice removal is not included. Water and electricity for your sprinkler system are your responsibility.
- Restrictions specific to Villa lots: No fencing of any kind is allowed on villa lots. No vegetable/herb gardens, hot tubs, spas, sports courts, basketball goals (permanent or portable), or playground equipment are permitted. Villas must have a garage for at least 2 vehicles, and exterior siding must be brick, stone, masonry, stucco, or wood (vinyl siding only with special approval). Minimum finished floor area is 1,200 square feet, and no villa may exceed two stories in front without committee approval.
- Assessments & fees (Villas): Villa owners pay an annual assessment (for common expenses) plus a separate annual villa assessment (for villa-specific services like lawn care and snow removal). The villa assessment is paid in equal monthly installments. After the developer turns over control to homeowners, annual increases are capped at 120% of the prior year without majority villa-owner approval, and at 150% with a 66⅔% vote. Special villa assessments may also be levied for unexpected costs.
