This declaration sets out the rules and obligations for owners of the townhome lots, including maintenance responsibilities, assessments, and use restrictions. - What you own & maintain: You own your lot and the townhome building on it. The association maintains the exterior of the dwelling (roof, siding, gutters, etc.) and common landscaping, but you are responsible for interior maintenance, glass, screens, and any fences or landscaping you add inside a fence.
- Assessments & fees: You must pay annual assessments set by the board, plus possible special assessments (for capital improvements, approved by 2/3 of owners) and individual special assessments for violations or damage. A working capital fee equal to one year's assessment is due at initial purchase. Master association dues are separate and additional.
- Leasing & rentals: You may lease your townhome, but if you do, your vote on association matters is limited to 49% weight. Tenants must occupy the home as their principal residence in Wake County to use common areas.
- Common areas & use: Owners have an easement to use the townhome common areas, but the association can suspend use for unpaid assessments (after 30 days) or rule violations (up to 60 days). You cannot alter common areas without permission.
- Enforcement & liens: Unpaid assessments become a lien on your property after 30 days and can be foreclosed. The association can also enter your lot to fix maintenance issues and charge you the cost plus a 15% administration fee.
