Surrey Meadows is a standard single-family homeowners association (HOA) in Apex, NC. These bylaws govern how the association is run—meetings, voting, the board of directors, and finances—and they apply to all lot owners. They do not contain the full set of property-use rules, which are in the separate Declaration of Covenants, Conditions, and Restrictions.
- Meetings & voting: Annual meetings are held, and special meetings can be called by the president, the board, or by members holding one-fourth of the votes. A quorum is one-tenth of the votes of each class. Members may vote by proxy, and any member more than 60 days delinquent on assessments loses the right to vote.
- Board of directors: After the initial period, the board has five directors, who need not be members. Directors serve staggered three-year terms, can be removed with or without cause by a majority vote of members, and receive no compensation (only expense reimbursement).
- Fines & rule enforcement: The board can fine for rule violations: $50 for the first, $100 for the second, and $100 per week for continuing or subsequent violations. It can also suspend voting rights and recreational facility use for unpaid assessments, and for up to 60 days for rule infractions after notice and hearing.
- Assessments & liens: Each member must pay annual and special assessments, which are secured by a lien on the lot. If unpaid for 30 days, a $25 late charge is added, and the association can sue or foreclose. Owners cannot escape liability by not using the common area or abandoning the lot.
- Budget & records: The association adopts an annual budget and sends it to members by January 5. An independent audit is done annually, with a report to members by April 1. Books and records are open for inspection by members and mortgage lenders during reasonable hours.
