Bexley at Weston is a single-family home subdivision in Cary, NC, governed by restrictive covenants that run with the land. These rules apply to all homeowners in the subdivision and are in addition to the master declaration for the Bexley at Weston HOA. This document focuses on lot use, building standards, and neighborhood upkeep.
- Land use & building type: Lots are for residential use only, with one detached single-family home (max 2.5 stories), a garage for up to 3 cars, and incidental outbuildings. Minimum heated square footage is 1,800 sq ft for one-story homes and 1,100 sq ft on the first floor for multi-story homes.
- Setbacks & house placement: Homes must be built within the recorded building envelope and face the street (corner lots may face the intersection). Setbacks follow Cary zoning rules.
- Fences: Fences must meet zoning and HOA approval. Only two approved types are allowed. No backyard fences on lots along Weston Pointe (Lots 7-10); rear fences on lots abutting Norwell Blvd and certain other lots must be 5' black vinyl.
- Parking & vehicles: Parking only on paved driveways or attached paved pads (max 2 vehicles). No RVs, boats, trailers, commercial vehicles, or inoperative cars visible from streets or other lots. Boats/trailers must be in an enclosed garage.
- Pets & animals: No livestock or poultry; only dogs, cats, or other household pets kept for non-commercial purposes.
- Nuisances & business activity: No noxious activities, outdoor clotheslines, or vehicle repairs visible from public view. Businesses require Cary Board of Adjustment approval.
- Signs & antennas: Only one real estate sign (max 10 sq ft) and political signs (max 10 sq ft, up to 60 days before election, removed within 2 days after). Satellite dishes allowed per FCC rules but must be in rear/side yard, not visible from street, and max 36" diameter. No free-standing towers.
- Pools & temporary structures: No above-ground pools (except small inflatable wading pools in backyards). In-ground pools allowed with Cary approval, fencing, and HOA approval. No temporary residences, trailers, or shacks used as homes.
