What Landingsatpinecreek's governing documents say
This is an amendment to the Declaration of Covenants, Conditions and Restrictions for The Landings at Pine Creek, a townhome community in Cary, NC. It updates the leasing rules for the community, which is governed by a homeowners association. This document is for current and prospective owners and renters to understand the rental restrictions.
- Leasing & rentals: Leases must be in writing, for a minimum of one year, and cannot be for transient or hotel purposes. Subleasing is prohibited. Owners must get written permission from the Board before leasing, and no more than 15% of the 68 lots can be leased at any time, with a waiting list managed on a first-come, first-served basis.
- Grandfathered leases: Owners with leases in effect as of the amendment's recording date can continue those leases for their remaining term without counting toward the 15% cap, provided they submit a copy of the lease to the association within 30 days of a written request. After that lease ends, the lot becomes subject to the cap and waiting list.
- Family leases: Leases to immediate family members (parents, children, sisters, brothers) do not count toward the 15% cap, as long as the owner provides a copy of the lease and identifies the family members in writing.
- Board discretion & waivers: The Board may waive any leasing requirement for demonstrated hardship, but must first notify owners on the waiting list and allow them to comment. Any waiver must be in writing.
- What this document doesn't cover: This is only an amendment to the leasing section of the Declaration. It does not cover other community rules like pet restrictions, architectural guidelines, or maintenance responsibilities, which are in the original Declaration.
