This is a second amendment to the covenants for Preston Point, a single-family home subdivision in Cary, NC, governed by a homeowners association (HOA). It updates the rules on residential use, leasing, and owner occupancy. The amendment binds all lot owners in the community.
- Residential use & restrictions: Each lot must be used only for single-family, non-transient residential purposes. No trade or business is allowed, and no structures other than one detached single-family dwelling and one private garage (for up to 4 cars) may be built. Garages and parking spaces are for passenger vehicles only; no planes, trailers, boats, campers, abandoned cars, or trucks may be parked there (except as allowed by Section 11).
- Leasing & rentals: Leases must be in writing, for at least 12 months, and cover the entire lot (no partial lot rentals). A copy of any lease must be given to the HOA within 30 days of signing or occupancy, and owners must respond to HOA requests for lease confirmation within 30 days.
- Owner occupancy requirement: A lot cannot be leased unless it has been owner-occupied for at least 24 consecutive months, starting from the deed recording date. Owners whose deeds were recorded before this amendment are grandfathered. The HOA can request proof of occupancy, and owners must respond within 30 days.
