This is the full declaration of covenants, conditions, and restrictions (CC&Rs) that binds all lot owners, and it also includes the association's bylaws. - What you own & maintain: You own your individual lot (Lot A or B) and the interior of your townhome. The association maintains all common areas, front yards, side yards, and the exterior of your home, including roofs, siding, gutters, and original privacy fences. You are responsible for your personal belongings, interior repairs, and any damage you cause.
- Assessments & fees: As of 2001, the annual assessment was $840 per lot, paid monthly at $70. It can increase each year with the Consumer Price Index without a vote, and larger increases require a 2/3 vote of owners. Special assessments for capital improvements also require a 2/3 vote, except for insurance shortfalls. Late payments accrue 10% annual interest plus a $10 late fee.
- Architectural review: Any exterior change—buildings, fences, walls, additions, or alterations—must be approved in writing by the architectural control committee (or the declarant while they own lots). Approval is automatic if no response within 30 days. Tree removal of protected species also requires approval.
- Parking & vehicles: Each lot has at least two parking spaces, with shared driveways between paired A and B lots. Boats, trailers, motor homes, and commercial vehicles are prohibited without written permission. Vehicles must not block ingress or egress for other owners.
- Use restrictions: Property is for residential use only, with single-family homes and limited 'light-housekeeping' apartments (max one bedroom). No obnoxious activities, trash, or inoperable vehicles may be left outside. Signs are limited to 'For Sale' or 'For Rent' and declarant's signs. No antennas, fuel tanks, or temporary structures without approval.
- Party walls & shared structures: Party walls, roofs, and foundations are shared between paired lots. Repair costs are shared proportionally, and disputes go to arbitration. You have an easement to access your neighbor's lot for construction, but must restore it afterward.
- Insurance: The association carries master insurance on all buildings (100% replacement cost) and liability coverage on common areas. You must insure your own personal property and personal liability. The association pays deductibles on property claims.
