This is an amendment to the Declaration of Covenants, Conditions and Restrictions for Willowbrook, a North Carolina homeowners association with both attached and detached homes. It changes membership classes, assessment rules, and annexation procedures. This document is a partial amendment, not the full rulebook.
- What this document doesn't cover: This is an amendment to the original Declaration, so it does not contain the full set of community rules (e.g., architectural guidelines, pet restrictions, or rental rules). Those are in the original Declaration and other amendments.
- Membership & voting: The association has three membership classes: Class A (owners of attached homes), Class B (the developer, with 3 votes per lot until certain conditions or Feb 1, 1997), and Class C (owners of detached homes). Each lot gets one vote, regardless of how many people own it.
- Assessments & fees: Annual assessments are set at $1,263.60 for attached-home lots and $1,440.00 for detached-home lots until the year after the first detached lot is sold. After that, detached-home assessments can increase up to 5% per year without a membership vote; increases above 5% require a two-thirds vote of each class. Assessments are due monthly.
- What assessments pay for: Assessments fund recreation, health, safety, and welfare of residents; maintenance of private roads, parking areas, sidewalks, driveways, and exterior of homes; reserves for capital improvements; hazard and liability insurance on common areas and homes; storm water drainage maintenance; and other common needs.
- Annexation of new areas: The developer can annex additional land within the area described in Exhibit F without member consent within 5 years of this amendment, if FHA or VA approves. Other annexations require a two-thirds vote of Class A and C members and two-thirds of Class B votes.
