What Blenheim Woods Community Association's governing documents say
This is a first amendment to the Declaration of Covenants, Conditions and Restrictions for Blenheim Woods, a single-family home HOA in Durham, NC. It amends the original declaration to transfer stormwater facility maintenance obligations from the developer to the homeowners association and to set up funding for those obligations. It is not the full rulebook; it only changes specific articles related to stormwater, assessments, amendments, and dissolution.
- Stormwater facility maintenance: The association assumes responsibility for inspecting, maintaining, repairing, and reconstructing the stormwater facilities, which are part of the common areas. The association must follow a supplemental agreement with the City of Durham and set aside funds for both routine maintenance and major reconstruction.
- Stormwater funding & reserves: The association must establish a separate reserve fund for major stormwater reconstruction, starting with $2,003.31, and increase it by at least 3% each year. It must also allocate $8,480.26 for inspection and maintenance, increasing by 3% annually, with carryover allowed. The city can require larger increases if needed.
- Assessments: Owners cannot waive or avoid paying assessments, and assessments cannot be offset by complaints about association actions. Special assessments may be levied for extraordinary expenses, including stormwater costs. A one-time assessment of $135 per lot was levied to fund the stormwater security deposit.
- Amendments & duration: The covenants run with the land for 30 years from the original recording, then renew automatically for one-year periods unless 67% of owners vote to disapprove. Amendments require a 67% vote, except the association can amend unilaterally to correct errors or comply with laws. Amendments must be recorded to take effect.
- Dissolution restriction: The association cannot be dissolved or terminated until fee simple title to the stormwater facilities has been transferred to an entity that agrees in writing to maintain them to the city's satisfaction.
