Brightleaf is a single-family home HOA in Durham, NC, specifically covering Tract 1, Phases 6 & 7 of the Brightleaf at the Park subdivision. This document is a set of restrictive covenants that bind all lot owners, and it supplements the broader Brightleaf Community Association Declaration. It tells you what you can build, how you can use your property, and what the HOA expects of you as a homeowner.
- What you own & maintain: You own your lot and the house on it, and you're responsible for maintaining your grounds, exterior, sidewalks, and mailbox. The HOA enforces standards for neatness and repair.
- Building & lot use: Lots are for residential use only, with one detached single-family home (max 2.5 stories) and a garage for 2–3 cars. Minimum heated floor area is 2,100 square feet. No lot subdivision is allowed.
- Architectural review: Fences, walls, driveways, parking pads, basketball goals, satellite dishes, and tree removal (over 6" diameter) require approval under the Declaration's Article X. Exterior changes must follow the Architectural Design Guidelines.
- Parking & vehicles: Parking is only allowed on improved surfaces like driveways or garages. No commercial vehicles, boats, RVs, or trailers can be parked on streets or lots unless enclosed in a garage. Pickup trucks (3/4 ton or less) are allowed if not a visual nuisance. Abandoned or inoperative vehicles must be hidden from view.
- Pets: Dogs, cats, and other household pets are allowed, but no more than 3 pets over 6 months old per lot without written board approval. Pit bulls, rottweilers, and other 'vicious' breeds are prohibited. Outdoor dog runs and cages are not allowed.
- Nuisances & business activity: No noxious or offensive activities, and no businesses that bring regular employees or non-residents to the lot. Basketball goals need approval. Political signs are limited to 6 sq ft, allowed 60 days before an election and must be removed 2 days after.
- Other restrictions: No above-ground pools (except small wading pools in summer), no exterior clotheslines, no septic tanks or wells for domestic water, and no temporary structures. Trash must be screened from view. Trees between the rear property line and rear setback must be removed only by hand tools.
