What Falconbridge's governing documents say
Falconbridge is a townhome community in Durham, NC, governed by a homeowners association (HOA). This document is the amended and restated Declaration of Covenants, Conditions, and Restrictions, which sets out the rules for owners, including assessments, architectural control, and use restrictions. It applies to all lot owners in the community.
- What you own & maintain: You own your lot and townhome; the association maintains common areas and provides exterior maintenance for roofs, gutters, exterior surfaces, trees, and walks, but not glass, heat pumps, or foundations.
- Assessments & fees: Annual and special assessments are levied per lot, with a maximum annual assessment of $300 per lot (adjustable by CPI or 60% member vote). Assessments are due 30 days from invoice; late payments incur a 5% penalty.
- Architectural review: Any exterior changes, including fences, additions, or rebuilding, require written approval from the Board (or an architectural committee) before starting. Plans must be submitted and approved within 30 days or approval is deemed given.
- Parking & vehicles: Each lot is entitled to two parking spaces. Boats, trailers, motor homes, and commercial vehicles are prohibited in common areas or streets; only cars, vans, and light trucks with current plates and inspection stickers may park overnight.
- Use restrictions: Properties must be used for residential purposes only. No obnoxious or offensive activity is allowed, and pets must be under owner's control at all times.
- Party walls & shared structures: Walls, roofs, and foundations built on lot lines are party structures, and owners share repair costs proportionally. Disputes are settled by arbitration.
- Insurance & damage: The association carries master insurance on buildings and common areas, with premiums charged as assessments. Damage or destruction is repaired by the association using insurance proceeds, with owners liable for any deficiency.
- What this document doesn't cover: This document does not specify current assessment amounts, pet limits, or rental restrictions; those may be covered in separate rules or amendments.
