What Heritage II Homeowners Association Inc's governing documents say
Heritage II is a single-family home HOA in Durham, NC, governed by a declaration of covenants, conditions, and restrictions. This document sets out the rules for owning a lot in the subdivision, including mandatory HOA membership, assessments, architectural review, and property use restrictions. It is the full rulebook for the community.
- What you own & maintain: You own your lot and single-family home in fee simple. The HOA owns and maintains the community use areas (common areas), and you have an easement to use them. You must maintain your lot and keep it free of debris and junk.
- Assessments & fees: The HOA can levy annual general assessments and special assessments (by majority vote) to cover community expenses. Unpaid assessments become a lien on your property after 30 days, accrue 10% annual interest, and can lead to suspension of voting rights and use of common areas.
- Architectural review: All construction, exterior changes, and even clearing/grading require prior approval from an Architectural Standards Committee. The committee has broad discretion to disapprove plans that don't harmonize with the neighborhood. Interior remodeling and interior painting are allowed without approval.
- Property use restrictions: Lots are for single-family residential use only. One detached house per lot (minimum 1,000 sq ft heated floor area), plus a garage for up to 3 cars. No mobile homes, tents, or temporary structures as residences. No commercial activity, no nuisance, and no junk vehicles visible.
- Parking & vehicles: No trucks over one-ton capacity, mobile homes, trailers, campers, or boats may be parked overnight where visible from other lots or streets. All vehicles must have current registration and inspection. Garage doors must stay closed except during actual use.
- Pets & animals: No animals, livestock, or poultry may be raised or kept, except reasonable numbers of dogs, cats, or household pets, provided they are not for commercial purposes and don't create a nuisance.
- Leasing & rentals: The declaration does not restrict leasing or rentals. Owners may delegate their use of common areas to tenants, but tenants must comply with the rules.
- What this document doesn't cover: This excerpt is the full declaration, but it does not include the HOA's bylaws, articles of incorporation, or any separate rules and regulations. It also doesn't specify the current assessment amount or any amenities like a pool or clubhouse.
