This is a Declaration of Easements between a developer (Perfect Corporation) and the Tarleton West Condominium Owners Association, not a full set of community rules. It grants reciprocal access, parking, and utility easements between two adjoining parcels (Parcel A, future townhomes, and Parcel B, the existing Tarleton West condominium) and sets out shared maintenance responsibilities for common areas like roads and utilities. It binds current and future unit owners of both properties.
- Access & shared easements: Each parcel grants the other a non-exclusive easement for walking, driving, parking, and utilities over its common areas and streets. No barriers may be erected between the parcels, and the easements run with the land perpetually.
- Parking restrictions: Tarleton West unit owners must park only in designated 'Tarleton West Parking' areas; they cannot park on Parcel A. Similarly, Parcel A owners cannot park in Tarleton West's designated spaces.
- Maintenance & cost sharing: The parties share maintenance costs for streets, landscaping, utilities, and lighting in certain areas (Area 1 split 50/50; Area 2 mostly Parcel A's responsibility). The developer must repave Area 1 within 60 days of completing its last unit. Maintenance does not include road improvements or upgrades.
- Insurance & liability: Each party must carry general liability and property damage insurance with at least $1,000,000 per person, $1,000,000 per occurrence, and $100,000 property damage. They release each other for casualty damage covered by insurance and indemnify each other for claims arising on their own property.
- Dispute resolution: Disputes about maintenance requirements can be submitted to binding arbitration under the American Arbitration Association rules.
