What Cedar Crest Community Association Inc's governing documents say
Cedar Crest is a single-family residential subdivision in Fuquay-Varina, NC, governed by a homeowners association (Cedar Crest Community Association, Inc.). The rules apply to all lot owners and their tenants, and they cover architectural control, property use, assessments, and leasing. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) for the community.
- What you own & maintain: You own your lot and the single-family home on it. The association owns and maintains the common areas (open space, entryways, roads, ponds, etc.) and can charge assessments for their upkeep.
- Assessments & fees: Annual assessments are set by the board, with a maximum that can increase up to 12% per year (or by CPI, whichever is greater) unless members vote to raise it further. A one-time working capital fee of $350 is due at closing from the first buyer. Special assessments for capital improvements require a 2/3 member vote, except for emergency assessments up to $500 per lot, limited to once every 5 years.
- Architectural review: Any building, fence, or exterior alteration (including paint colors, landscaping, and signs) must be approved in writing by the Declarant or the Architectural Review Board. Approval is deemed denied if not granted within 60 days. The Declarant has broad discretion, including purely aesthetic grounds.
- Leasing & rentals: You may lease your home, but leases must be in writing and for at least 6 months. The lease must include a clause requiring the tenant to comply with the CC&Rs and association rules.
- Pets & animals: You may keep common household pets, but no more than 2 dogs per lot. Pit bulls, rottweilers, Doberman pinschers, and bees are prohibited. Poultry (except roosters) is allowed in appropriate enclosures. If you have a dog, your rear yard must be fully fenced. The board can require pet removal after repeated violations.
- Parking & vehicles: Boats, RVs, and trailers cannot be parked on your lot without approval. Vehicles carrying hazardous materials are prohibited. Inoperative vehicles must be stored in enclosed garages.
- Signs & flags: Political signs are allowed only from 45 days before an election to 7 days after, and must be no larger than 24x24 inches. US and NC flags are allowed up to 4x6 feet. Other signs and flagpoles require association approval.
- What this document doesn't cover: This document does not specify the exact annual assessment amount (it references an exhibit not included here) or list specific amenities. It also doesn't detail the association's bylaws or rules for common area use, which are separate documents.
