This is an amendment to the Declaration of Protective Covenants for Rand Meadows, a single-family home subdivision in Garner, NC, governed by a homeowners association (HOA). It updates and restates key rules about building materials, maintenance, parking, and architectural review. This document is a partial rulebook—it amends specific articles but does not include the full original declaration.
- Building materials & construction: Homes and detached garages must be built with brick, hardiplank, stone, or masonry stucco; mobile homes, log homes, modular homes, and similar are prohibited. Detached garages must match the main dwelling's exterior and roof pitch. Accessory buildings and fences require HOA board approval.
- Lot maintenance & debris: Owners must keep lots free of tall grass, trash, and debris; garbage must be in covered receptacles and removed weekly. No burning or dumping. Builders must keep sites clean and provide portable toilets. The HOA can correct violations at the owner's expense.
- Nuisances & vehicles: No noxious or offensive activities are allowed. Mobile homes, trucks, and cargo trailers cannot be placed on lots. Boats, campers, and motor homes must be concealed from streets or parked off-street with approval; temporary parking over 72 hours requires notice. Junked or inoperable vehicles are prohibited, and commercial vehicles over 2 tons cannot park overnight.
- Antennas & outdoor equipment: No radio, TV, or other antennas are allowed except satellite dishes up to 24 inches in diameter. No outdoor poles, clotheslines, or similar equipment; flagpoles are permitted. Mail receptacles need HOA approval.
- Architectural review: Any building, fence, or exterior change (including swing sets, pools, and color changes) requires prior approval from the Architectural Control Committee and HOA board. If no decision within 30 days, approval is deemed granted. Fences cannot exceed 6 feet and must be wood, masonry, vinyl, or approved material.
- Easements & utilities: Utility and drainage easements exist on the front and rear 10 feet of each lot and 5 feet along side lot lines. No structures, plantings, or fences may interfere with these easements; owners maintain them, and utilities may cut trees or grade as needed.
- Dispute resolution & waivers: The HOA board can waive minor violations with written approval from a majority of lot owners. Disputes go through a process: committee review, then board review, then an emergency homeowners meeting where a majority vote is final.
