This is a stormwater maintenance covenant and easement agreement for the Langston Ridge subdivision in Knightdale, NC, between the developer, the homeowners association, and the Town of Knightdale. It is not a full set of HOA rules; it specifically governs the maintenance, repair, and replacement of stormwater control facilities (ponds, wetlands, etc.) that serve the community.
- What this document covers: It creates a perpetual obligation for the HOA (and ultimately each lot owner) to maintain stormwater control facilities in strict compliance with the Town's approved operations and maintenance manual, and grants the Town an easement to inspect and, if necessary, perform maintenance.
- Who is bound: The covenants run with the land and bind all current and future lot owners in Langston Ridge. Membership in the HOA is mandatory for every lot owner.
- Stormwater assessments: The HOA must levy annual assessments on all lots to cover stormwater maintenance costs, including insurance, replacement contributions, and other expenses. These assessments are common expenses and cannot be less than the required stormwater expense, even if the budget isn't ratified by members.
