Belmont Ridge is a planned community of detached single-family homes in Raleigh, NC, governed by a homeowners association (HOA). This declaration sets out the rules and obligations for all lot owners, including assessments, use of common areas, architectural controls, and leasing restrictions.
- Assessments & fees: Annual assessments start at $500 per lot (as of 2004) and can increase up to 10% per year without a vote; larger increases require a 2/3 vote of Class A members. Special assessments also require member approval. A one-time $200 working capital fee is due at initial sale.
- Leasing & rentals: Owners may lease their home, but leases must be in writing, for at least 6 months, and include a clause binding tenants to the HOA rules. Owners must provide the association with a copy of any lease.
- Architectural review: Before making exterior changes (buildings, fences, signs, major landscaping), owners must submit plans for approval. The Declarant (or later the HOA) has 30 days to approve or deny; a fee up to $125 may be charged.
- Common areas & amenities: All owners have access to common areas, but the association can suspend use for unpaid assessments or rule violations. A fenced common area and horse barn are reserved for owners of Lots 2, 3, 4, 13, and 14, who may pasture up to 2 horses per lot and share maintenance costs.
- Voting & membership: Each lot gets one vote in the HOA. Owners who lease their home or don't occupy it as their primary residence have their vote limited to 49% weight on any matter.
- Enforcement & liens: Unpaid assessments become a lien on the property and can lead to foreclosure. Late fees and interest (up to 18% annually) may be added. The HOA can also suspend voting and common area use for violations.
