This is an amendment to the Declaration of Covenants, Conditions and Restrictions for Daltons Ridge, a single-family HOA in Raleigh, NC. It modifies specific rules about board powers, assessments, maintenance, architectural review, and signs. It is not the full rulebook, but it shows important changes that affect homeowners.
- Board powers & spending limits: The Board cannot enter multi-year contracts or make non-budgeted expenditures greater than the current year's budgeted reserve without approval from 75% of voting members.
- Assessments & fee increases: Annual assessments cannot increase more than 10% over the prior year unless approved by two-thirds of voting members.
- Maintenance responsibilities: The Association is responsible for cleaning gutters and downspouts and maintaining trees, shrubs, grass, and walks in front and rear yards. Owners are responsible for replacing dead trees, shrubs, or other plantings within 12 months, or the Association may do so and place a lien if unpaid.
- Architectural review: The Architectural Committee's decisions are subject to Board review. Minor plantings (under 4 feet tall in existing beds) and replacing existing vegetation with like vegetation do not require approval. Fences cannot exceed 6 feet tall.
- Signs & flags: Only 'For Sale' signs advertising the sale of the lot and home are permitted. One flag holder may be attached to the front and one to the rear of the home without approval. Permanent free-standing flagpoles are not allowed, but temporary flagpoles displaying federal, state, or local government flags are permitted.
- Garbage bins & screening: City-required garbage bins may be kept outside without screening if they are not visible from the curb directly in front of the home (or from the front and side curbs for corner lots). Other equipment and storage must be screened.
