It binds the Inona Place Homeowners Association and all lot owners to maintain the stormwater basins, and grants the City of Raleigh rights to inspect, repair, and assess for non-compliance. - Stormwater maintenance responsibility: The Inona Place Homeowners Association is the Responsible Party that must maintain the two dry detention basins (SCM#1 near Lot 31 and SCM#2 near Lot 51) per the approved Stormwater Operations and Maintenance Manual and Budget, including quarterly inspections, trash removal, and annual engineering inspections.
- Assessments & liens: The Association may levy assessments for stormwater maintenance costs, and unpaid assessments become a lien on the lot. If the City performs maintenance due to non-compliance, it can also levy assessments and place liens on delinquent lots.
- City enforcement rights: The City of Raleigh has permanent easements to inspect and maintain the stormwater facilities, and can seek specific performance or reimbursement if the Association fails to maintain them. The City is not obligated to maintain the facilities.
- Insurance requirement: The Responsible Party must maintain liability insurance of at least $1,000,000 for the stormwater control facilities.
