What Padden Place Townhome Owners Association Inc's governing documents say
Padden Place is a townhome community in Raleigh, NC, governed by a homeowners association (HOA). This declaration of covenants, conditions, and restrictions (CC&Rs) is the rulebook for owners and residents, covering assessments, maintenance, and use restrictions.
- What you own & maintain: You own your townhome lot, but the association provides exterior maintenance (roofs, siding, gutters, landscaping, etc.) for all living units. You are responsible for your rear yard upkeep, and the association can revoke that right if you don't keep it neat.
- Assessments & fees: Monthly assessments fund common expenses and exterior maintenance. The initial maximum was $100/month (through 1997), with annual increases capped at 10% or CPI, whichever is greater, unless members approve more. Special assessments for capital improvements require a 2/3 vote, except the board can approve one up to $500 every three years without a vote.
- Leasing & rentals: No living unit may be leased for less than six months, so short-term rentals are not allowed.
- Parking & vehicles: Each lot is entitled to at least two assigned parking spaces. Boats, trailers, campers, motorhomes, trucks, and tractors cannot be parked on the property or adjoining streets, except in a closed garage if rules allow.
- Architectural review: Any exterior changes, including fences, signs, or plantings, require written approval from the board or architectural committee. Approval is based on harmony of design and location, and the board can refuse for purely aesthetic reasons.
- Pets: Dogs, cats, and other household pets are allowed, but not for commercial purposes, and they must be controlled and not a nuisance.
- Use & conduct: Property is for single-family residential use only. No business, industry, or offensive activity is allowed. Signs are restricted, and window screens on the front of townhomes are prohibited.
- What this document doesn't cover: This excerpt does not include the full bylaws, rules and regulations, or any current fee amounts. It also doesn't specify age restrictions or any amenities beyond basic common elements.
