What Lakepoint's governing documents say
This is an amendment to the Declaration of Covenants, Conditions, and Restrictions for Lake Point Cottages, a townhome community in Moore County, NC. It updates the original 1983 rules, shifting exterior maintenance responsibilities from the association to individual owners and clarifying other provisions. This document binds all lot owners in the community.
- What you own & maintain: Owners are now responsible for all interior and exterior maintenance of their unit, including patios, fencing, decks, siding, roofs, posts, gutters, walks, and trellises. The association no longer maintains these exteriors except for painting and roof shingle replacement, which are done on a board-determined schedule and paid for by special assessment.
- Assessments & fees: Annual assessments can increase each year by the Consumer Price Index increase without a vote, and can be raised further with a two-thirds vote of members. Special assessments for capital improvements require the same two-thirds approval. Delinquent assessments accrue 8% annual interest plus late charges, and the association can foreclose on the property.
- Leasing & rentals: No lease for renting a property may be for less than six months. This applies to any rental agreement with the owner.
- Parking & vehicles: No vehicles may be parked permanently in driveways or common areas (each unit has a two-car garage), except by board permission for owners of three powered vehicles. Trailers, boats on trailers, tractors, vans, and recreational vehicles are prohibited, except short-term visitor RVs.
- Pets: Dogs, cats, or other household pets are allowed, but no animals kept for commercial purposes, and no livestock or poultry.
- Architectural review: No building, fence, wall, or other structure, and no exterior addition or alteration, may be made without prior written consent of the Board of Directors. This includes changes like boat docks, which also require approval.
- Use restrictions: Lots are for residential use only, with one family as principal residence. No noxious activities, temporary structures, outdoor clothes drying, or visible signs without permission. Garbage must be stored inside the residence unless the board approves changes.
