- Assessment increases: Starting January 1, 1981, the maximum annual assessment can increase by up to 5% each year without a membership vote. Any increase above that requires a two-thirds vote of each class of members, with 30-60 days' written notice.
- Annexation of additional property: The original declarant, River Birch Associates, may annex adjacent property to the HOA within five years without lot owner approval, provided FHA and VA determine it aligns with the approved plan. This annexation cannot change existing covenants for current property.
